Exterior Modifications Guidelines

The Wynfield Forest Declaration of Covenants, Conditions and Restrictions is a 30-plus page document that you received when you purchased your house. Think of it as our community’s “constitution.” It details such issues as property rights, the structure and function of the Homeowner’s Association, assessments, easements, restrictions and rules, dispute resolution, architectural standards, and more.

Please be aware that the Declaration of Covenants, Conditions and Restrictions is part of the deed to your house. When you agreed to purchase a house in Wynfield Forest, you also agreed to abide by all the provisions set forth in the Declaration of Covenants, Conditions and Restrictions.

Mission Statement

The Architectural Review Committee of the Wynfield Forest Homeowners Association strives to protect the property values and to preserve the quality of life for all homeowners while at the same time providing the exercise of individual expression in the customization of our homes.

The focus of the Architectural Review Committee is to review proposed changes to the exterior of any home to ensure that such changes preserve the continuity of the villages and neither detract from the aesthetics of the community nor diminish the enjoyment of the community by all residents.

This document is not intended to replace the Declaration of Covenants, Conditions, and Restrictions but rather to clarify and simplify the process by which homeowners may modify the exterior presentation of their homes and lots.

The Architectural Review Committee must accept plans in writing before construction begins. The Architectural Review Committee is not responsible for ensuring structural integrity, or impervious violations. Each homeowner is responsible for obtaining all necessary building permits and other government approval, which may be required.

Impervious Area
It is not the responsibility of the Architectural Review Committee to ensure there are no violations to the total allowable impervious area. It is the property owner’s responsibility to remain in compliance with Mecklenburg County law. The following section is inserted only as a guide to help residents of Wynfield Forest understand how the impervious area affects their additions and modifications to the home. This section is not intended to be a legal interpretation of the ordinance.

Wynfield Forest is located in an area that has been designated by Mecklenburg County as a watershed area. While we have such beautiful surroundings we must also accept the responsibility of maintaining the watershed area. Zoning restrictions, put in place by Mecklenburg County, for Wynfield Forest have a limit to the amount of impervious area that can be constructed on your lot. An impervious area is any space, roof, sidewalk, driveway, and walkway that will not allow the absorption of water from a storm event. Decks, pools, and ponds are not classified as an impervious area and do not impact the total impervious area of the home.

Calculations for the total allowable impervious area and the existing impervious area can be found on your property survey. Total allowable impervious area is calculated based on the square footage of your lot. Larger lots have more allowable impervious area than do smaller ones. Existing impervious area is the total square footage of the roof, sidewalks, driveways, porches, etc. Your survey should have impervious areas illustrated on the drawing of the home. Additions to the home that are impervious will be added to the calculation of the total allowable impervious area when it comes time to re-sell your home. Any overage of the total allowable impervious area will most likely have a negative impact on the ability to sell the home. For information regarding the impervious area, please contact Mecklenburg County Land Use & Environmental Services Agency at 704-336-3569.

Exterior Paint ColorsBack to Top
Approval is required to repaint the exterior of a structure unless the same color is being used to repaint. Color chips are to be submitted with the Application for Approval of Exterior Design Change.

Walkways, Driveway Widening, Landscape Walls & Curbs Back to Top
Application for Approval of Exterior Design Change is required. A copy of your survey with the proposed change sketched in is helpful and necessary for the committee to respond in a timely manner. Description of construction materials with colors and styles is also helpful.

Pools, Ponds, & Water Fountains Back to Top
Approval is required. A copy of your survey with the proposed change sketched in is helpful and necessary for the committee to respond in a timely manner. Description of construction materials with colors and styles is also helpful. This type of construction should not affect the total allowable impervious area; but to be sure, check your property survey or with the Mecklenburg County Land Use & Environmental Services Agency.

Storm Doors, Windows, Pedestrian DoorsBack to Top
Storm doors must be full-view glass. Homeowners must submit an application to the Architectural Review Committee for approval.

Gazebos, Trellises, & Lattice Back to Top
Approval is required. The application must include:

  • The proposed modification, including diagrams and pictures as necessary.
  • Materials (i.e.: wood, pressure treated wood, composite wood, or vinyl)
  • Color

Decks, Screened Porches Back to Top
Approval is required. Modifications to decks include but are not limited to:

  • Staining
  • Enclosing
  • Extending

Decks may be stained. If the choice of color of the stain is not consistent with the community or is not of a color deemed natural to wood, an application for approval must be submitted.

Conversion of a deck or patio into a screened porch requires the submission of an Application for Approval of Exterior Design Change. Note that screened porches contribute to the impervious area calculation.

Decks may be extended if the materials and colors used are compatible with the existing deck. Extension of a deck or patio requires the submission of an Application for Approval of Exterior Design Change.

Awnings Back to Top
Approval is required. Awnings covering a deck may be allowed if:

  • The awning is attached to the back of the house,
  • The awning is retractable, and
  • The materials and colors used are consistent with the existing color scheme of the house.

Dog Pens Back to Top
There shall be no dog pens or dog runs of any kind permitted in Wynfield Forest.

Fences Back to Top
Approval is required. The Fencing Design Guidelines for Wynfield Forest provide five options for fencing:

  1. Wooden Three-Diamond Rail fence composed of three diamond cut split rails with a welded wire fabric screen.
  2. Wooden Three Board fence composed of three 2" x 6" pressured treated boards or available wood-composite material, natural stain or color (no paint) with a welded wire fabric screen. This fence is similar in appearance to above-mentioned split rail. The boards are fastened to the outside of the 4¢ x 4¢ posts with the wire screen secured between boards and post.
  3. Virginia Gothic Picket fence with matching Virginia Gothic topped post.
  4. Westchester Style fence identical to the one installed along Wynfield Creek Pkwy. This is the only fence, which may extend into the landscape easement abutting Wynfield Creek Pkwy.
  5. Shadow Box Privacy fence. Note this option is the only privacy fence allowed. Fences of this type may not exceed 6¢ in height nor be used to enclose the perimeter of a property in part or in whole. This fence may be used to enclose a deck or a patio. However, if the deck or patio becomes enclosed and/or covered, it may be subject to other restrictions.

Each option for fencing has additional requirements and restrictions. Please consult the Fencing Design Guidelines for additional information.

Other fencing restrictions:

  • Chain-link fences are prohibited by Exhibit C section 3d of the Declaration of Covenants, Conditions, and Restrictions.
  • Fences are not permitted in the front yard and must tie into the main structure at least 36 inches behind the plane created by the front façade of a residence.
  • Fences may not extend outside of a homeowner’s lot.
  • Fences are not permitted on easements
  • With no exceptions, fences on corner lots must be 16 feet from the curb because of the required 15-foot easement.

Garbage Cans Back to Top
Garbage and recycling containers should be placed in your garage. They may be placed outside only if they cannot be seen from the street or are stored in an approved “blind” specifically constructed for that purpose. Construction of a trash blind requires the submission of an Application for Approval of Exterior Design Change.

Composting Back to Top
Backyard composting is allowed. You must use a composting bin that has a lid. This keeps the odor to a minimum.

Backyard Play Equipment & Basketball Goals Back to Top
Approval is required. Includes swing sets and climbing type toys. Basketball goals are allowed with the following restrictions – they cannot be attached to the house, they must be 6 feet from the property line, and the pole must be black. This applies to portable goals as well.

Flag PolesBack to Top
House-attached flagpoles of the standard 60-inch lengths are permitted. Freestanding flagpoles of any height may be placed in the homeowner’s backyard only. An application must be submitted to the Review Committee for approval.

Detached Storage ShedsBack to Top
Approval is Required.

  • Maximum size: 12’L x 10’W x 8’H
  • Exterior: Can be brick, vinyl or masonite siding
  • Color: Color must match trim or main structure
  • Roof Shingles: To match main structure
  • Location: Set back 4 feet from back & side property lines

Type:
Constructed on site to meet local building codes. Doors must match the main structure in style and color. Structure can be built on concrete blocks but must have a lattice skirt around the foundation to cover the blocks.

Pre-fabricated vinyl shed with color and siding consistent with main structure. 

Landscaping: Detached storage sheds must have a landscape screening on at least three sides (3’ min height)
