Lien and Foreclosure Procedures
If payment and applicable late fees are not received by the Management Company on the stated date the required paperwork is sent to attorney.
A title search/exam is performed on the property at the homeowner’s cost.Based on title search/exam, a Claim of Lien is filed on the property.Appropriate Lien notification letters are sent to the Management Company and to the homeowner by registered mail.
Once the Lien is filed, all further correspondence between the homeowner and Hawthorne Management, is handled through the Association’s attorney’s office only.
If payment is not received within 30 days after a specific date to satisfy the Lien, the Foreclosure by Power of Sale is filed upon receiving written notice from the Board of Directors. Once the total past due assessment amount is above $1,000.00 and the Board of Directors will proceed with the foreclosure process.
A pre-foreclosure letter is sent to the homeowner by registered mail stating the foreclosure process will begin if the past due assessments as well as any fees are not received by the Association’s attorney on a specific date.
This Notice of Foreclosure is sent to the homeowner by registered mail.A Notice of Hearing letter is sent to the homeowner within 30 days after Notice Letter is sent by registered mail, outlining the date of the hearing and a tentative sales date. |
