Violations Process

The specific violation is identified specifically by either Hawthorne Management or the Wynfield Forest Board of Directors.

A notice is sent via regular mail identifying the violation along with the covenants pertaining to the specific violation. The homeowner must bring the property into compliance or correct the violation that meets the standards of Wynfield Forest.
A second notice is sent via regular mail, after thirty days of no compliance to the first letter stating that the violation still exists. The problem is addressed as in the original notice, it is again stated what must be done and the time frame in which to correct the violation.

Ten days later, upon no compliance by the homeowner, a third notice is sent by regular mail is sent stating the violation still has not been corrected. The violation is restated, and actions that must be done to correct the violation. All possible consequences of failure to comply are outlined in this final notice.

After non-compliance by the homeowner, a Notice of Hearing is sent via registered mail requesting the homeowner to meet with the Board of Directors. The homeowner will be allowed 15 minutes on the agenda (first item) to state their position and offer possible remedies. The homeowner is excused and the Board members will discuss the issue, taking into consideration the homeowners’ comments. A motion will be taken by the Board as to how to proceed with the homeowner and the violation. Actions could include fines and/or denying access to community’s amenities.

Within ten days, actions from the board will be sent via registered mail stating the Board’s decision and any deadlines or fines to be imposed.

If a homeowner has received a violation letter and would like to respond, all homeowners are asked to respond in writing to the Association by mailing to:
